Fitzsimons Mallon issued proceedings in 86 cases against the Chief Constable for Special Services Police Officers’ incursion at the Derryhirk Inn, Lurgan in March 1997.
Class action on behalf of 86 patrons attending the public house who were held captive by Special Police Agents. Case involved significant complexity in the issue of public anonymity certificates against discovery of intelligence, screening of Police Agents at disciplinary enquiry and Court Proceedings. Case resulted in special presentation of psychiatric evidence in the group action by Dr Oscar Daly, Consultant Psychiatrist to the British Psychiatrists’ Association on post traumatic stress disorder in a group or class action. Significant compensation awarded to 86 clients. Spotlight BBC devoted an entire program to this significant case.
